Role
Who you are
- The ideal candidate will have experience in the fintech space and with M&A transactions
- 4-7 years experience practicing law required, with a minimum of 2 years in-house experience
- Juris Doctor degree required
- Strong customer service and team orientation required, with desire and ability to take on new opportunities and tough challenges with a sense of ownership and urgency
- Outstanding written, oral, research and negotiation skills required; attention to detail is a must
- Strong deal-making and legal project management experience preferred
- In-house experience with a technology or financial services company preferred
- Excellent computer skills required, including advanced skill level with G-Suite products, Jira and Slack
- The successful candidate will demonstrate
- Fluency with, or eagerness to learn about, technology to the extent necessary to counsel the business
- Flexible, proactive self-starter, hard-working, quick-learning and comfortable with informed decision-making
- Business judgment and ability to assess legal risk while providing pragmatic advice
- Strong analytical and advisory skills, including the ability to review, evaluate and effectively counsel business colleagues in a variety of departments on complex and routine legal questions relating to various business issues with unfailing discretion and impeccable integrity
- Ability to multi-task to consistently deliver outstanding, thoughtful and focused results in a fast-paced and high-growth environment
- A good sense of humor
- Interest in Employment law is a plus
What the job involves
- We are looking for a highly motivated, entrepreneurial, corporate counsel to serve as Commercial Counsel
- You will assist with several vital legal initiatives, among them contract review and negotiation, counseling our finance and operations team, and human resources and employment matters
- This is an exciting opportunity to work on challenging technology and business issues, supporting senior counsel. As we expand our offerings, your ideas and contributions will make an immediate impact
- Draft, review, and negotiate various types of commercial agreements, including master services, licensing, professional services, marketing, consulting, strategic partner, and nondisclosure agreements -- Vendor and commercial agreements will be the primary focus of this role
- Coordinate with compliance, operations, sales, new markets and other teams at EarnIn to ensure that the vendor and commercial deals we enter into will support EarnIn’s current and future product development
- Interpret and advise on contract requirements, rights, and obligations, and provide assessments regarding risk exposure
- Provide guidance to resolve issues that arise in commercial relationships, including but not limited to, handling pre-litigation disputes and inquiries
- Assist in the development and implementation of contract templates, playbooks, and negotiation guidelines to improve operational efficiency
- Assist with due diligence efforts with respect to M&A transactions and other strategic transactions, as well as post-acquisition integration legal matters
- Support employment and HR matters including employment agreements, terminations, workplace policies, and internal investigations. (if interested)

Our take

By allowing hourly workers access to their pay as it is earned rather than on a fixed date, it hopes to provide all Americans with the ability to deal with immediate costs without going into arrears.
Unlike competitors in this growing space such as Dave, Earnin charges no mandatory fees, instead gaining revenue through a voluntary tipping system. It also requires no credit checks to access its services, which puts it ahead of the growing number of digital banking solutions. This approach has garnered it a strong user base of over 300,000 business customers which offer Earnin as an employee benefit. Around 70 million paycheck advances were taken through the platform in 2022 alone, totalling $5 billion. Since then, this number has grown to an overall earnings access value of $15 billion.
Earnin is growing despite current difficulties in the wider tech landscape and is continuing to hire in all departments. It will continue to improve upon its offering and expand its network of businesses, aiming to give every employee in America control of the money they've earned.
