Role

Who you are

  • A J.D. degree
  • Demonstrated experience advising clients on commodities or securities transactions and applying the laws relating to trading, clearing, margining, and reporting requirements for securities and commodities products
  • A background in drafting and negotiating security and/or commodity trading and clearing agreements, preferably including ISDA, and other structured product agreements
  • Strong knowledge of federal securities and/or commodities trading regulation, including experience with SEC, FINRA, CFTC and NFA regulatory structures
  • FINRA and securities trading legal experience
  • Close attention to detail and the ability to manage multiple projects
  • Enthusiasm for crypto, an understanding of the space, and are ready to adapt traditional laws to this new asset class
  • Some combonation of the following: conscientious, adaptable, collaborative, creative, curious, and humble

What the job involves

  • We are looking for a Lead Counsel, (Associate General Counsel, Trading) to help build out and manage new trading products and services for our institutional clients in the U.S. and globally
  • This person will advise and support the digital asset brokerage lines of business from a legal perspective
  • They will be a true business partner within the legal team to identify and solve real time challenges of creating a new financial system. We need someone to assist with digital asset trading matters both structure and operations - all mission critical to our operations. In addition, we need someone with the intellect and curiosity to help us build our business holistically
  • Structure and support the trading business line from a legal perspective
  • Analyze complex regulatory frameworks and communicate findings clearly
  • Complexity and Impact of Work:
  • Shepherd certain affiliates through various brokerage regulatory approvals
  • Analogize precedential and historical regulations and guidance to new and innovative products and structures
  • Organizational Knowledge:
  • Execute with moderate supervision and balance commercial and legal entities
  • Build a team as we grow
  • Navigate an ever-changing regulatory landscape to build policies and procedures with the trading solution team
  • Communication and Influence
  • Help advise company leadership on existing and emerging legal issues, with particular focus on brokerage and trading issues
  • Work closely with compliance team on policy updates/management of policies and procedures

Financial backing for Anchorage has come from prestigious investors Visa and Andreessen Horowitz. Anchorage's broad offerings are set to be matched by plans to partner across a wide spread of neobanks, challenger & incumbent banks, and corporate treasurers. This would mean an impressive expansion of their already substantial domain of influence in a rapidly developing sector.

In early 2021, Anchorage secured a national trust charter from the OCC, making it the first-ever federally chartered digital asset bank. This is significant, as it provides a good barrier to entry for other companies looking to compete in this space, and gives legacy institutions the ability to offer digital asset access to their clients. Though it has raised considerable funding in the past, crypto instability and wider macroeconomic challenges forced Anchorage to cut 20% of its staff in March 2023. 2022 clampdowns on customer due dilligence internal controllers added to the pressure on Anchorage to streamline and refocus its efforts.
